Oh my goodness. It's that time again. It's Free agent time and the New York Yankees are trying to cut under their $197 million dollar luxury tax limit, where if their payroll goes over that amount, they must pay at 17 percent fine to the league to fund the salaries of poorer teams that cannot pay such hefty payrolls. The Yankees are at 15 million dollars below the payroll luxury tax limit after signing a huge player such as Giancarlo Stanton. They are trying to improve their infield so that they can be the best team in the American League East.
The Baltimore Orioles have a great third baseman named Manny Machado. He is one of the best players in the club and his contract is only through 2018 for 18 million dollars, just over the luxury tax limit for the New York Yankees. Sticky Smooth is an agent extraordinaire and has signed several great players in the past such as Alexander Rodriguez, Alfonso Soriano, and Mark Teixiera to the Yanks. He now has the opportunity to represent Manny Machado and try to pry him away from the Baltimore Orioles and bring him to the Bronx.
Sticky negotiates with the Orioles and makes an offer to bring Manny to an Al East rival for three prized AAA prospects and $2 million dollars in cash concessions. The Orioles refuse so that Yankees will not become the greatest team in the universe next summer. The Orioles are in bad shape. Their pitching is an embarrassment to baseball and their only chance of bringing people to Camden Yards next summer is keeping Manny Machado from the Yankees with his speed and power to the opposite field.
Sticky listens to Manny. Manny says to Sticky "Get me to Yankee Stadium, so that I can get to the World SEries next year! I dont care if I lose a couple of million dollars." Sticky knows that the Yankees only have 15 million dollars to play with which is less than the 18 million that he is already getting with the Orioles. In addition, the Orioles aren't going to allow the Yanks to walk all over them next season. Sticky says to the Orioles "How about I pay your team $3 million next year to lose so that Yankees have a better chance of getting to the playoffs, as long as Manny is part of the trade to New York? This request is illegal and Sticky is almost out of options in getting him to New York. The Orioles acknowledge that its a building year and know they are not going to the playoffs next year. ( Similar to the Mets, Twins, Marlins, etc). They take the deal and agree to complete just enough to make them a medioocre team. Manny Machado is now a New York Yankee, and they are ready to take on those Astros!!!!!
1. Is Manny Machado responsible for the tort that Sticky has committed?
2. Can the Principal be responsible for the actions of the agent in this process?
3. If Sticky says "No" to Manny's order to do whatever it takes, can Manny sue Sticky for violating his fiduciary responsibility to Manny?
4. If the Yankees take the deal with the Baltimore Orioles, but the Orioles beat the New York Yankees next season, ( no really through) is there any legal justification that Yankees can take agains the Orioles?
