Oh, My, What To Do?
Paralegal Lindsey was recently hired by a large California firm, and was assigned to the worker's compensation department of her firm. This week, however, the worker's comp attorney and her experienced paralegal are both on vacation and the firm has loaned Lindsey to the antitrust department to work with a new attorney, Tom, who asks Lindsey to draft a complaint.
Lindsey is unsure at first, but with some research she is able to draft a four page complaint which she believes covers the basics. When she shows it to Tom he glances at the complaint, smiles broadly and says it is fine, signs quickly, and asks her to file it and have it served. Lindsey doubts it is fine and is concerned about filing her work product.
What should she do, and how? What might happen if the complaint is filed as it is?What might happen to Lindsey?
