This week we were asked by our professor to select a past or current issue in employment law in the United States, describe the issue, and explain how employment law was applied in the resolution.
From classmate--The New Mexico State Corrections will be paying fines of over 700,000 for their part in an age discrimination case. People over age 40 are a protected under the Age Discrimination in Employment Act. The lawsuit accuses the New Mexico State Corrections of age discrimination practices regarding job assignments and promotions. Even worse the lawsuit states the organization also retaliated against other employees because they spoke up or disagreed with the practices. The effected parties received payment for the mistreatment as well as positions they would have been placed in if not discriminated against.
In addition to the hefty fines they defendants also has update policies and procedures, conduct employee training, and even reevaluation of previous position changes. The resolution also includes a regular evaluation of current practices to ensure no more ageism is happening.
This case was eye opening for me because I did not know that age 40 and over was protected. I have worked at places where I saw ageism took places but usually at ages over 50. In researching this lawsuit, I found several other with similar law breaking and similar high dollar fines, rightfully so.
