Okello left Uganda with his parents when he was just 2 years in 1985 after a military coup that ousted the Obote II regime. His father was an army officer attached to MBUYA MILITARY BARRACKS. His father died in Congo last year whereupon Okello decided to return to Uganda. Okello had been told by his father that he had built a house in Nakawa/Mbuya, Kampala and that he should try to trace the said property. Therefore Okello last week started to hunt for the said family house and he ended up in within the prohibited radius of MBUYA MILITARY BARRACKS. The officers at the quarter guard arrested him and have planned to hand him over to the police to be charged accordingly. It has been mooted that at the time Okello and his father left Uganda the law criminalizing movement within the prohibited radius of the military barracks had not been made. In any case, Okello was looking for his father's house and was not interested in being in a MBUYA MILITARY BARRACKS, despite the fact that he was born in Mbuya Military Hospital. Moreover, he did not know that it was a barracks, otherwise he would not have ventured there. As he was being apprehended Okello struck one of the military men and he disarmed him. Okello honestly believed these military men were interfering with his liberty, and as such he had to respond accordingly. In the process Okello injured the said military man, who was hospitalized in the military wing for two weeks. The commanding officer of MBUYA MILITARY BARRACKS has handed Okello to the police to be prosecuted for the alleged offence of being found within the prohibited radius of a military installation. The Magistrate court in Mbarara granted Okello bail and while on bail Okello noticed a young charming lady whom he befriended and took out. The young lady appeared to be 19 years of age. Because she was well-fed on milk and other nutritious foods, she looks older than her age. She is in fact 16 years. Okello has been sleeping with this girl at a lodge in Bugolobi for the last 2 days. It is even feared she may be pregnant by Okello. Identify and briefly discuss all legal issues involved in the problem of Okello, including applicable defenses.
