Oliver Owner owned a house that he rented out. Oliver rented the house to Robert Renter and his wife. Robert's wife did some remodeling in the house, including installing new carpet on the floors, new cabinets in the kitchen and painting the bedrooms. Robert paid for the carpet, floors and paint. Later, Oliver promised to payRobert's wife $5,000.00 for the carpet, floors and the other work Robert's wife had done. Oliver and Robert signed a document to this effect wherein Oliver agreed to pay Robert the $5,000.00 for the carpet, floors and paint.

Afterwards, Oliver refused to pay for the carpet, floors and paint so Robert filed a lawsuit against Oliver for breach of the promise that Oliver would pay. As the Judge of the District Court hearing the lawsuit, you are conducting a bench trial, meaning there is no jury. Explain the ruling you would make and the legal basis for your ruling.
