Tom hears that there have been a number of break ins reported in the area of his farm. Tom goes out to the farm and places several "no trespassing" signs up around the farm yard. Inside the farmhouse he hooks a loaded shotgun up to a string. He then leaves.
Late that night, Gary, who does not know Tom, is driving on the road past Tom's farm. Gary's car stalls and Gary does not have a cell phone. It is only about 30 degrees outside so Gary walks to Tom's farm. It is dark and Gary cannot see any of the signs. Gary is very cold and seeing that no one is home at Tom's farm crawls through a window to the house. As he is walking Gary sets off the shotgun and is severely wounded.
Gary survives and wants to sue Tom. Imagine you are the lawyer representing Gary. What torts would your lawsuit be based on and what would the defenses be?
