On February 1, Holly is hired as an agent for Fresh Tec., a food processing company. She has worked many years in this business and has a great deal of excellent experience. Her job instructions are to source new foodservice contracts from various restaurants and entertainment venues for Fresh Tec. Her contract expires on April 30. An important aspect of her job is to be aware of the varying prices of lettuce and tomatoes, as this is critical to the profit margin of her principal. Currently, lettuce wholesales at $2.24 a kilo and tomatoes at $4.75 a kilo. According to agency law, she has many duties as an agent. Part 1 Fully describe the various duties owed by Holly to Fresh Tec and illustrate the consequences of breaching these duties by giving examples. Look for 7 duties. I will accept at minimum 5 duties. Part 2 Given the previous facts, determine the possible outcomes if Holly negotiates a contract for the salad ingredients, lettuce, and tomatoes at a price above the current price during the time of her contract and a similar contract, after the expiration of her contract. As well, Holly receives gift certificates from a chain of restaurants as an incentive from the restaurant chain for the lower, than the current wholesale price of salad products that she contracted for on behalf of Fresh Tec. She did not mention these gifts to her principal. What does this mean from an agency law standpoint? Determine the possible liabilities. Use correct agency law terminology in your answers. This is an optional assignment. Pass/Fail
