On January 4, Denise texts Marcus offering to sell him her new Mac-Air laptop for $800.00, but her text also says she needs an answer from him by January 8, 11:59 p.m. Marcus sees her text message offer on his i-phone on January 4, and calls his Uncle Joe asking to borrow the money. Marcus has no computer, and knows a great deal when he sees one. However, on January 5, Marcus loses his i-phone. On January 7, having not heard back from Marcus, Denise changes her mind and texts Marcus saying the offer is off the table. On January 8, good old Uncle Joe gives Marcus the $800.00. Since he has no I-phone Marcus immediately calls Denise at 11:58 p.m. from Uncle Joe's house phone saying "I accept your offer, I'm coming over right now with the $800.00!" Denise replies "nope, sorry Marcus, too late." Was a binding contract formed for the sale of the laptop that Marcus can enforce ?
