On March 3, 1976, Bob started the Big City Dude Ranch ["BCDR"). The BCDR provided a rugged outdoor experience for "city folk" who rarely had an opportunity ride horses, hunt for game, sh in wild rivers and all the other outdoor "charms" only available at a place like Bob's. After decades of success, Bob decided it was time to retire. Rugged Times [a nationwide chain dude ranches) made a very generous offer to purchase BCDR. After prolonged negotiations, Bob and Mr. Shorty {president of Rugged Times]I enter a contract for the purchase and sale of BCDR. Shortly after the sale is completed, a dispute arises about whether or not the following items are included in the sale. The contract is silent concerning these items: 1. Bob's 1976 Ford F250 pickup truck; 2. A picture of Bob shaking heads with then president Gerald Ford. The picture hangs in the front ofce and is held in place by four screws and a safety strap. The screws and strap can be easily removed; 3. A built in [i.e., underground) sprinkling system. used to water the ranch's many grassy areas; and 4. A Cold Shed used for storing a broad selection of adult beverages. The shed sits on a concrete pad and is held in place by eight safety hooks [two on each side). The hooks can be easily released so that the shed can be moved from one part of the ranch to the next. For the last 20 years, the shed was often placed on top of Bob's pickup and driven throughout the park.
