1. On November 1, Builder enters into a contract with Owner to construct a home according to specifications in return for $1 million, which is to be paid in installments. The contract specifies that Owner's first installment payment of $100,000 is due on November 15 and that Builder must begin construction by December 1. One specification in the contract is that all of the pipe used in the construction be manufactured by the Reading Pipe Co.

On November 10, Builder informs Owner that he will not use pipe manufactured by the Reading Pipe Co.; however, Builder states that he will use pipe of an equal quality.
