On November 15, 2020 Walter and Samira entered into a tenancy agreement. Walter agreed to rent Samira's townhouse for $2000 a month (payable on the first of each month) and he was entitled to possession of the home on December 1, 2020. When they signed the agreement, Samira asked Walter to pay first month's rent (which Walter paid) but she did not ask for a last month's rent deposit. Walter was hospitalized in late November and was not able to move into the rental unit until December 15. When Walter paid his rent on January 1st, 2021, he paid only $1000. He claimed that he was entitled to a credit for the first two weeks of December since he was not yet living in the townhouse. When Walter paid his rent on February 1st, 2021, he paid the full monthly rent of $2000. Samira decided to apply this amount towards a last month's rent deposit. Samira is now claiming that Walter is in arrears of rent in the amount of $3000.00 - $1000 for January's rent and $2000 for February's rent.
