On September 1, 2022, we filed the Summons and Complaint in the matter of White vs. Brown (Case No. BC234567) in the Los Angeles Superior Court at the Spring Street Courthouse located at 123 N. Spring Street, Los Angeles, California 90012. The case was assigned for all purposes to Judge Maria in Department 26.
I am concerned about having Ms. White's case in front of Judge Maria because about 6 months ago, I rear-ended Judge Maria's priceless antique car in the courthouse parking lot. Although I apologized profusely to Judge Maria and offered to pay for the damage, she was so upset that he said, "ATTORNEY MICHELLE! You are the worst driver! I hope you manage your cases better than you drive your car!"
Given this unpleasant exchange and our representation of Ms. White, I am worried Ms. White will not receive a fair and impartial trial in front of Judge Maria.
The Questions : - Can we remove Judge Maria from the case? - What is the Code of Civil Procedure (CCP) Section governing this issue? - How does this CCP Section apply to our facts? - Explain the legal research steps you took, i.e. what search terms did you use? - Where did you look in LexisNexis to figure out the issue presented by Attorney Maria?
