On Monday, at 9 am, Ben sees the car but he is late for work and telephones John from work and offers $140,000.00 and John says he will consider it. Charles goes to John's house on Monday at 11 am but Sharon, John's wife, is the only one at home. Charles leaves a note saying: "Keep car for me. I am very interested." Monday evening, John decides to accept Ben's offer and telephones him at 2:30 pm, saying: "I will accept your offer of S140,000.00 but can you pay cash?" At 4:30 pm, Monday, John receives Charles acceptance by post with a cheque for $150,000.00 and immediately calls Ben and leaves a recorded message: "Deal off.*** Ben is away on business and only listens to the voice message on Tuesday morning. At 8 am on Tuesday, Dawn is taking her morning walk in the neighborhood and sees the notice and knocks on the front door and finds John at home. They talk about her transportation woes and how much she really needs to get a car. She promises to talk to her bankers and get back to John later that week. John and Dawn have been neighbours for a long time.
