Third Party Rights At Tom hires ABC Contracting to install new siding and windows on his house and also to do all new landscaping. They enter into a contract that Tom is going to pay ABD a total of $60,000.00. There will be a $20,000 down payment; $20,000 paid when the siding and windows are done; and the remaining $20,000.00 when the landscaping is done. Tom makes the down payment and ABC goes to work. They do the siding and windows and Tom gives them the additional $20,000.00. Since ABC started doing work, each of Tom's neighbors have experienced an increase in value in their homes. They have had professional opinions that once the landscaping is done, their home values will increase by an additional 10%. ABC left the job site after the siding and windows were done and never finished the landscaping. Tom is too lazy to sue. Tom's neighbors decide they want to sue to enforce the contract. Discuss whether you think the neighbors are intended or incidental beneficiaries and if they should have the right to sue. Original post due Monday April 25th.
