Ordinances and state orders are expiring around the country that require masks, but in many locations, businesses can still require customers to wear a mask inside their business. Taryn woke up one morning and wanted a smoothie. Taryn hopped in the car and drove to her favorite smoothie shop, MB. Looking at the long drive-thru line for smoothies, Taryn parked, put on her mask and walked in the shop.
While waiting in line, Taryn noticed a person (Steve) in front of her not wearing a mask. The individual working for MB at the counter (Angela) looked up and asked Steve to please put on a mask or please leave and use the drive-thru.
Steve did not have a mask, but also did not want to wait in the drive-thru line. Steve was getting close to being late for work, but he needed six cups of coffee for his co-workers who had paid him to pick-up coffee and deliver it that day. Steve ignored Angela and continued waiting in line. Angela asked Steve again with much more force in her voice.
Steve looked up at Angela and yelled, "it is my freedom to not wear a mask and in a second I am going to hit you."
MB got completely quiet. Steve looked around at everyone, and yelled "this is ridiculous!" Steve stormed out of the store, but not before Steve grabbed a bottle of water and a cheese snack out of the cold case.
The manager of MB, Robi, ran after Steve, grabbed Steve's keys, and said "you have to pay for these or I am going to call the police." Realizing he could not leave, Steve said nothing, but started to wrestle the keys back from Robi.
In the meantime, Taryn had walked outside and had been filming with her phone the entire events outside. Shortly after Steve and Robi began to scuffle, a police officer happened to pull into MB.
The police officer quickly took control of the situation and began to sort things out, which included arresting Steve. Taryn posted the video of the events and it went viral. Steve received probation for the theft, but has been losing sleep and has significant mental health issues after many individuals online made disparaging comments about Steve's behavior.
1.In these events, we have Taryn, MB, Angela, Steve, Steve's co-workers, Robi, the police officer and others in the MB. Identify any civil claims (think torts and contracts) that each of them might have. FULLY explain and analyze whether these claims would be successful.
2.Identify any decisions involving ethics that were made in these events and explain why you do or do not believe they were made ethically.
