Oregon is concerned about the many video games that are sold in their state that involve serious violence and are played by young children. Therefore, the Oregon State Legislature enacts a statute that prohibits the advertising of all video games that are rated as M (Mature) or Adult over 18. Despite this new statute, the president of Games Marketing, Inc. (GMI), orders GMI marketers to place ads in various media for their video games, including those rated M or Adult. When a GMI ad appears on WMTV, a television station in Oregon, for an M rated game, GMI and WMTV are held in violation of this statute. GMI now must defend themselves.
