For about a month after his eviction, Oscar's home had been the couch of whichever kind friend was willing and able to take him in for a while or, when a friend's couch was not available, his car.

One night, Oscar was unable to find a place to stay, so he drove his car to the parking lot of a local public park and nestled into the back seat to sleep. It was a humid summer night, so he kept his front windows open halfway. Felix passed by and,seeing Oscar's car with its open windows, decided to sneak over and see if there was anything he could steal from the car. Felix went to the front passenger side window, reached in through the open window, and opened the glove box of the car. He felt around inside and found Oscar's wallet, which Oscar had inadvertently left in the glove box. Felix started to remove the wallet from the car when Oscar woke up and yelled, "Hey! Stop, thief!"

Frightened, Felix dropped the wallet on Oscar's seat and ran off. Oscar started to give chase (he wanted to make sure Felix was sufficiently scared that he would not return), but in his drowsy state he tripped, fell, and hit his head hard on the parking lot asphalt when he fell. Oscar died later that night from his injuries.
