Our client, Vilma Montano, is a master stone mason from Venezuela. She has been living and working in Canada since December 15, 2022.She applied for permanent residence as a Federal Skilled Worker under the Immigration and Refugee Protection Regulations. She submitted evidence of her education and training, including certification with the Master Stone Mason Guild in Venezuela and associate membership in the Guild of Master Stone Masons of South America and the Caribbean. She provided proof of English language proficiency and documents evidencing her Canadian work experience with Flintstone and Rubble Heritage Restorations. Despite the strength of her application, Vilma was denied permanent residency under s 75(2) of SOR/2002-227. She was notified of the decision in writing on March 4, 2024. She has retained our firm to seek judicial review of the Immigration Officer's decision.

The grounds of Vilma's application are as follows:

• The Immigration Officer incorrectly assessed her work experience under s 75 of the Regulation.
• The Immigration Officer incorrectly assessed her educational credentials under s 78 of the Regulation.
• The Immigration Officer incorrectly assessed her language proficiency under s 79 of the Regulation as Ms. Montano is fluent in Spanish, and proficient in spoken French and English.
• The Immigration Officer incorrectly assessed her family relationships in Canada under s 83(5) by not giving proper recognition to the nature of the broad definition of "family" in South American culture.
