Pam, the twenty-one-year-old victim, went to a bar to have a few drinks. There she met Ed Suskind. After a conversation, Pam told Ed that she had to leave. Suskind asked Pam for a ride home. She agreed, but told him, "I'm giving you a ride home just as a friend, nothing else." He said, "Oh, okay." When they got to his building in an unfamiliar part of town, Ed twice asked her to come up to his apartment. Pam declined both invitations. He kept saying, "No." Pam was really scared by the look in his eyes. She said, "If I do what you want, will you let me go without killing me?" When she began to cry, he put his hands on her throat, starting to lightly choke her. Pam said, "If I do what you want, will you let me go?" He said, "Yes," and she proceeded to do what he wanted, performing oral sex and sexual intercourse. Is Suskind guilty of rape?
