PANDA was living on the street with very little money. He entered the local corner store, the Geary Market, run by Gus. Gus knew Panda as a petty thief who had stolen from him before. Gus was tired of getting ripped off. It was happening more and more. Sometimes the robbers would threaten him with weapons. On this day, Panda was spending a lot of time in the back of the store where Gus could not see him. Gus stored extra bottles of liquor back there and wondered what was taking Panda so long. Panda was trying to figure out how to steal a small bottle of vodka. He put it in his waistband and slowly walked toward the exit. Gus saw Panda leaving the store and said, "Hey, don't leave the store or I'll shoot you". Panda stood still for a few seconds and then threw the vodka bottle at Gus. It missed him, hit the back of the wall, and shattered. Panda then ran from the store out to the street. Gus grabbed his gun from under the counter and went to the street. He saw Panda racing up the street. Gus fired the gun in the air intending to scare Panda and make him think twice before trying to steal from him again. The bullet bounced off a light pole and struck Panda in the leg, causing a bad injury.
