PAR 102 Civil Litigation Procedure I: ANSWER ASSIGNMENT: DUE: 12-10- 2021 Prepare an answer on behalf of Defendant May Forrester (only) to the complaint in Chapter 5 of the textbook (exhibit 5-5: Hendricks v. Forrester complaint). Make up the name of her attorney (your supervisor) and required contact information in Nevada. Use Exhibit 6-11 as your model. Admit the following: Paragraph 1: admit all except: "this is a civil action involving, exclusive of interest and costs, a sum in excess of $75,000", which should be denied Paragraphs 2, 3, 4 & 5: Admit in entirety. Paragraph 6: Admit all except .. "that Defendant May Forrester made the following false and fraudulent representations to plaintiffs: Defendant represented that certain real property was ideal vacation property, that said property had been approved for and was suitable for building, that said property abutted a man-made lake, and that said property was worth at least $100,000", which should be denied. Deny the following: Paragraphs 7 through 10, 12, 15, 17 through 20. Denial upon information and belief. Paragraphs 13 and 14. CAUTION regarding Paragraphs 11 and 16: These two paragraphs should be answered in a manner such as that utilized in PARAGRAPH 3 of the Sheffield answer on page 183. Affirmative defense: Statute of limitations. Look up the Nevada Statute of limitations for fraud or mistake. You will make up evidence regarding this defense to be able to allege that Plaintiffs missed the deadline to file their cause of action for fraud. Cite the statute. Ask the court to deny Plaintiff's requested relief and ask for relief for Defendant Forrester.
