Part 1

The Ontario Government is finally allowing restaurants to reopen although Covid 19 is still a major problem in the province.

You and two of your friends have decided to open up a restaurant now, but there are many legal issues you are concerned about.

In particular you are worried about being sued by your customers during this trying time, and what effect that might have on your personal assets.

Discuss the legal issues that might be relevant to your business and how you would protect yourself from liability.

In particular address and fully discuss, the appropriate form of business you would form when starting your restaurant. Please explain why you chose the form of business you decided to use.

You must use and explain the applicable laws (from our course material) when discussing the legal issues for your restaurant.

Please do not just copy the notes or the text. Please use your own words in your assignment and relate the laws to your restaurant.

In particular you should focus on the business chapter for this part of the assignment.

Part 2

It is now phase 3 and your restaurant has been open for a couple of months.Unfortunately, there has been a new outbreak of the corona virus and the Ontario Government is ordering all restaurants to fully close (other than take-out food orders).

You have decided that you are no longer able to keep some of your employees due to this forced shut down.

1) You have decided to terminate your manager who has been working at the restaurant for 10 years.

2) You have also decided to terminate your chef because you have caught him stealing from the cash register.

3) Finally, your dishwasher Steve has quit because you reduced the number of shifts per week from 6 days per week to 2 days per week. Steve has informed you that he will sue you for wrongfull dismissal but you feel that because Steve quit he is not entitled to any money.

Discuss what your obligations are with respect to these employees.
