Now that you have undertaken research required for legal compliance in the 6 scenario areas, you are required to use organisational communication methods to share your updated regulatory knowledge.
Address your email to your colleagues and outline the finding of your research about the requirements for:
- contractors to provide WHS policies and procedures to ensure they are compliant - what information/policies do you want to be able to sight to be confident they are managing their obligations and risks?
- requirements for staff who are involved in the sale and supply of liquor to hold RSA certification.
The 6 legal scenarios
Read each scenario. Then follow the instructions to complete each part of your project, using scenarios 1-6.
The scenarios are tailored to one of The Experience Co-operative businesses across the travel, tourism, hospitality, and events industry.

Scenario 1 - Superannuation law
Noor manages payroll for The Event Co., a part of The Experience Co-operative. Noor is new to the organisation and is highly experienced in superannuation compliance for payroll. During a recent sample audit, Noor discovered superannuation payments had not been updated to the new rate by the due date required. This situation was not picked up by Noor's predecessor, and payments have been at the wrong percentage for 2 quarters. Noor also noticed that The Event Co. was routinely missing the deadlines for paying superannuation, resulting in a recent fine from the ATO. Noor would like your help in understanding the legal risk and compliance requirements in ensuring superannuation is paid correctly.
Scenario 2 - Work, Health, and Safety law
Cameron is a senior office supervisor. Cameron works for The Travel Curators, a part of The Experience Co-operative. Cameron tells you they are conducting a review of workstation ergonomics and manual handling. A staff member had recently reported concerns and is currently on sick leave due to a lower back injury obtained while lifting and moving a stationary delivery. Cameron asks you to review the legal risks and provide actions to strengthen compliance.
Scenario 3 - Food Safety law
Lenah is an experienced food and beverage coordinator. Lenah works for The Hospitality Co-operative, which is part of The Experience Co-operative. It is currently peak season, and there has been a lot of staff turnover. Lenah has concerns that the food safety program is not being adhered to. Some of the temperature control requirements are not being met. Lenah has noticed incomplete documentation on at least 3 shifts, including the logs that record the temperature of foods before, during and after service, refrigerator temperatures and the cleaning checklist. Lenah knows there is a potential problem and would like your help identifying risks and strengthening workplace systems and avoid receiving a negative report should they be audited/inspected.
Scenario 4 - Privacy law
Ajay works in client care as a relationship manager. Ajay works for The Event Co., which is part of The Experience Co-operative. Ajay's role is to manage client profiles and client communication. Client care profiles include personal identification such as name, date of birth, address, and email address. All client profiles are subscribed with permission to the company newsletter. Ajay tells you they are constantly contacted by other marketing services. Marketers want to purchase access to the company client database. The database would be used to offer clients travel insurance and other useful products. Ajay is unsure and wants to know if there are legal risks or compliance requirements the business needs to address.
Scenario 5 - Liquor Licencing law
Liang works for The Event Co., who are a part of The Experience Co-operative. The Event. Co. runs themed market events offering entertainment, food and bars in an outdoor environment, subcontracting stalls to restaurants and artists. The bar is licensed to a subcontractor in a certain area of the themed market, and the licensed area is marked out with green tape. However, there are often problems with patrons bringing their own alcohol into the venue or purchasing alcohol and then moving out of the licensed area if there are no seats. Liang does a walk-through before and during the market operating hours. Liang often observes that employees working in the subcontractors' licensed areas are quite young and seem to be inexperienced. There is also often who seems to be in charge or supervising the young staff and no evidence of a badged manager. Signage about responsible service and the boundaries of the licensed areas is also scant. Liang does not have a register of subcontractor licensing status, proof of staff holding the correct responsible service of alcohol certification or the existence of responsible service of alcohol policies. Liang wants to understand the legal risk and any compliance requirements.
Scenario 6 - Trademark law
Riley is a communications manager, specialising in website content and social media. Riley works for The Travel Curators, which is part of The Experience Co-operative. Riley tells you they were tagged on social media by customers, who highlighted that a competitor appears to have copied the business logo, branding and style. Riley has checked the competitor's website and social media and confirms that the website copy is nearly the same, with social media photos using very similar branding and styles. Even more alarming is the near copy of the business logo. A search of the IP Australia register reveals that neither The Travel Curators nor the competitor has their logo registered. Riley asks you to identify and explore the legal risks and what can be done to protect the business logo.
