Partnershp 2 Joyce and her cousin, Valencia, operated a juice and smoothie bar called Squeezed Sisters about two blocks from their house. Joyce took care of her elderly mother in the evenings and Valencia hired someone to work in the shop from 6:00 - 9:00 p.m. every night. On June 17, 2015, Joyce went home and gave her mother her evening medications. This usually made her mother a little sluggish. Valencia called Joyce saying that she needed her to come back to work because the evening worker called in sick and Valencia had to pick up her children from daycare before it closed. Joyce said that she would come back but would have to bring her mother. She could not leave her alone after she took the medication. Upon their arrival, Joyce and her mother both slipped and had a bad fall on some smoothie that Valencia had spilled next to the counter in her hurry. Joyce's mother suffered a broken hip and her son filed a lawsuit against the partnership to cover the cost of his mother's medical bills and physical therapy. Valencia, on behalf of the partnership, argued that Joyce was negligent in trying to seat her mother at the counter without checking the floor. Valencia argued to the trial court that Joyce had a duty to indemnify Squeezed Sisters because of her negligence in seating her mother.
