Pascal has been working in administration for Cineplex movie theatres for 5 years although he has not been doing much lately. Yesterday, his boss called him and said that, given the fact the government still has not re-opened movie theatres, the employer can't afford to keep him on right now, but they hope things will improve soon. Pascal is confused - he asks if he is being fired. Oh no, says his boss, we are just laying you off for a short time. I will call you when there's work for you. Pascal is totally confused what this means, he thought 'laid off' means fired. He looks at his contract and it does not say anything about the employer being able to lay him off. He asks you what this all means and what his options are.

(PART ONE - 5 MARKS) Explain what this 'layoff' means under the Employment Standards Act and what Pascal is legally entitled to and what he needs to do etc.

(PART TWO - 5 MARKS) Explain what this 'layoff' means under Common Law and what Pascal is legally entitled to and what he needs to do etc.
