Pat is a prosecutor in River City.
One night, Pat was sitting in a car at River Park watching the river in the moonlight. A green sports car pulled into the same parking lot about seventy feet away. A woman with long red hair got out of the car and threw (what appeared to Pat to be) a pistol into the river and then drove away.
Two days later, the River City Police informed Pat that on the same night Pat was in the park, Victor Vandergeld was killed assassination style, with a bullet to the brain stem while kneeling with his hands tied behind his back. The police say they suspect Carry - a person believed to be a professional mob enforcer in the River City organized crime world.
The police file has a picture of Victor's wife, Farrah. Farrah has long red hair and drives a green sports car. Pat does not tell anyone what he saw. Pat is eager to prosecute Carry because everyone considers Carry a dangerous criminal. Pat takes personal charge of the case. Police know the style of Victor's murder matches what they believe would be Carry's method of operation. Carry has no alibi; a week earlier, he was seen accepting money from a local mob boss to whom Victor owed money. Carry also seemed to have a romantic interest in Farrah. Pat has Carry arrested and charged with first degree murder.
Pat puts on a press conference where Pat announces: "We have caught the notorious mob assassin, Carry, red-handed in the murder of Victor Vandergeld. My office will seek a conviction of this professional criminal. But we need the public's help - Let us know if you saw anything on the night of the murder." Pat then turned to the Police Chief, who was also at the press conference, and said "Isn't that right, Chief?"
After the press conference, Farrah went to the police station. She says that, on the night of the murder, she saw Carry sitting in a car across the street from their house when she left the house to go for a drive.
Is Pat subject to discipline? Answer according to ABA and CA law.
