Pauline Mason died on 12 April this year. A copy of Pauline's will, and associated correspondence is attached to this assessment paper how can I advise the Executors as to how they should distribute Pauline's estate, using UK legislation and cases.

Pauline invited Stephen and I to dinner on 18 March. During dinner, she announced that she was giving her shares in Greville Haulage Ltd to our grandson, Daniel. She asked us if we would look after the shares for Daniel until he is 18, and we both agreed. On 2 April, Pauline sent us a letter, a copy of which is attached. She enclosed the share certificate and a stock transfer form. However, my sister was in hospital with a serious infection at that time. I spent a lot of time visiting her and was also very anxious, so I never even looked at the letter or its enclosures until after Pauline died. Pauline phoned me several times after she sent the letter, to ask me ifI had dealt with the paperwork. I kept telling her that everything was in hand, but in reality I was just too worried about my sister even to think about anything else. I got the paperwork out a couple of days ago, planning to send it to Greville Haulage Ltd this week, but I noticed that Pauline had not signed the stock transfer form. I feel absolutely terrible about it, as I suppose it is now too late, isn't it? Immediately after Pauline died, Stephen and I went to Barclays Bank and asked for the box containing the jewellery that Pauline mentioned in her will. On opening the box, we found a number of valuable items ofjewellery. However, there was also a note indicating that an emerald bracelet had been removed on 14 March and sent to Hawkes Jewellers. There was no emerald bracelet in the box, so I contacted Hawkes Jewellers to see if they still had it. I attach a copy of the letter they sent to me, and also the letter I subsequently received from Julie Armitage. You will see she claims the bracelet belongs to her, but Abigail Mason is furious and insists that she is entitled to it. I do hope you can sort everything out. On 14 March, our late client, Pauline Mason, instructed us to repair a broken clasp on an emerald bracelet. She paid our professional fee in advance and left the bracelet in our possession. At the same time, she informed us that she had given the bracelet to a friend, Julie Armitage. Mrs Mason asked us to notify Ms Armitage, rather than herself, when the bracelet was ready to be collected. Mrs Mason was very clear that we should give the bracelet to Ms Armitage, as it now belonged to her. A member of our office staff contacted Ms Armitage on 6 April to tell her that the bracelet had been repaired. Ms Armitage collected it from us later that same day. We had been friends for many years, having been at school together. After dinner, we went into the sitting room, while Pauline went to make some coffee. When she came into the room, I remember seeing a piece of jewellery on the tray alongside the coffee cups. Pauline held it up and I realised it was the emerald bracelet that she received from her parents on her 18th birthday. We chatted a bit about the day when Pauline received the bracelet and how thrilled she had been. Pauline rotated the bracelet gently in front of the lamp and the emeralds really sparkled as they caught the light. Pauline then said: 'Julie dear, I want you to have this bracelet. You have been a wonderful friend for many years, and I know how much you will enjoy wearing it'. I protested that it was much too valuable, but Pauline insisted that she wanted me to have it. She mentioned that she was giving most of her jewellery to her daughter, Abigail, but she said she wanted me to have this specific piece, as a memento of our lifelong friendship. She then said: 'I originally planned to give it to you tonight, but I'm afraid the clasp is broken. I've arranged for it to be repaired by Hawkes Jewellers, so you can have the bracelet after that. I will tell them thatI am giving it to you, and that they are to contact you to arrange collection when it is repaired'.
