Penny, a potential client of the accounting firm of ADAMS BAKER & CLINE (ABC), arrived at the firms offices for a consultation meeting with one of the partners. Penny, who had traveled a good distance for the meeting, asked the receptionist, Jane, where the restroom was located. Jane pointed in the general direction of the restroom and began giving directions, but was interrupted. Penny (understandably in a hurry) rushed in the direction of the restroom but missed the door which was clearly marked RESTROOM. At the end of the hallway she noticed a sign on a door which said EMPLOYEES ONLY. Hoping the relief of a restroom awaited her on the other side of the door, Penny went through it only to find the firms filing room. A precariously placed, balanced, and overstuffed cardboard file box sat atop a set of shelves near the door. When Penny opened the EMPLOYEES ONLY-marked door, the doors movement disturbed the box, causing it to fall upon Penny, breaking her nose and bruising her face. Once a potential client, Penny now becomes a plaintiff, suing ABC. Is ABC liable to Penny for her injuries?
