77. (1) A person shall be disqualified from receiving any benefit or assistance for any period during which that person is undergoing imprisonment or detention in legal custody.

It is the view of some that social security benefits that are due to a person who is at the time incarcerated shall not be receiving that benefit whilst incarcerated, but shall do so retroactively when released. Others, however, view this as that the person will not ever receive the benefit (cash payment) for the said period of incarceration even upon release. Discuss possible legal interpretation .
