Pharma Solutions Inc. is a leading pharmaceutical manufacturer based in London. One of their top products is an antacid tablet that requires artificial orange flavouring approved for use in medication. OrangeEssence.com is an online supplier that specialises in food-grade flavours, including those suitable for drugs and supplements.

On 15th January 2024, Dave, the head of procurement at Pharma Solutions, visited OrangeEssence.com, which listed their artificial orange flavour as 'pharmaceutical- grade and suitable for use in tablets and capsules.' Dave placed an order for 500 kilograms of the orange flavouring at 5,000. The contract stipulates that the goods should be delivered in packs of 1 kilogram each.

The flavouring arrived at Pharma Solutions' factory on 1st February 2024. Dave observed that approximately 10 packs were 2 kilograms each. Moreover, although all packs seemed intact from the outside, a subsequent analysis revealed that about 100 kilograms did not meet the purity standards required for medication manufacturing. These packs contained trace contaminants that could potentially react with the active ingredients in the antacid formula.

Pharma Solutions Inc. aims to repudiate the contract and recover the 5,000 already paid to the seller. Advise Pharma Solutions Inc using uk case laws and uk resources with in text citations essay IRAC style
