Phillip Atkins was sentenced to death for the kidnapping and murder of a 6-year-old child after he confessed to these heinous crimes in 1981. Atkins case was a multi-layered case, and it took eleven years to send him to prison with the death penalty and he raised eighteen points to the Florida Supreme Court in his multiple appeals, in an attempt to not be sentenced to death. Atkins v. Singletary, 965 F.2d 952 (C.A.11 (Fla.),1992). Atkins argued that the trial counsel was not effective for presenting no expert testimony of the involuntariness of his confession. The court held that even if the mental state of a defendant could be a significant factor regarding involuntariness, their mental state alone does not remove the question of constitutional involuntariness. Atkins at Id. 959. In our case with Ziggy, he was arrested by the D.E.A. and at the time of his arrest, he was read his Miranda rights and did not want an attorney to represent him so waived his right to legal counsel. Ziggy claimed that the Messiah would protect him and then he confessed to all the drug charges against him but said that the Messiah ordered him to deal drugs. Ziggy gave an extremely long loquacious lecture to the D.E.A. on how the Messiah runs his life and is above all laws, deeming him incapable of knowing right from wrong. Ziggy knowingly and voluntarily waived his Miranda rights, no matter what the Messiah told him or made him do, so Ziggy's confession will more than likely be inadmissible.
