In law school, students are often to required to present their writings in what is called theIRACformat.IRACstands for Issue, Rule, Analysis, and Conclusion. Find an issue in your particular area of law. For example: In criminal law the court system is constantly attempting to balance citizens' rights under the Fourth Amendment and the need for police to conduct searches and seizures in order to protect those citizens.

Once you have your issue or issues, then provide support for your position using case law, statutes, regulations, and scholarly articles. Present pros and cons to your position on the issue because nothing in the law in clear cut. Once you have provided your rules and analysis, then write a conclusion/solution to the issue presented at the beginning of your paper.

You may select a topic or subtopic from your readings. Here are some examples that come to mind:

  • The need for tort reform vs ensuring that a plaintiff is properly compensated for any harm done to his or her person in the healthcare setting.
  • The potential need for a reform of the medical coding system.
  • Legal liability of a hospital, physician, nurse, or other medical staff vs. ethical responsibility of a hospital, physician, nurse or other medical staff.
  • Various ethical dilemmas that arise from procreation and end-of-life
  • I'm a big fan of "constitutionalizing" any topic. What sections of the Constitution or Bill of Rights affect your particular area of law and topic?

Those are just a few examples off the top of my head, but hopefully they paint a clear picture. Feel free to use any of these topics, but you are not required to do so. I wanted to give you all the freedom to research and write about something that matters to you. Additionally, these scholarly articles can be a good jumping off point to find relevant statutes, case law, and regulations for your particular paper. Your text book cites many different cases so researching these cases may be a good place to start as well and lead you to other relevant case law or case law with an opposing view.

The research paper, 12-point font, double spaced, and 8-10 pages. Your paper should have a minimum of 6 sources, which includes peer-reviewed articles, statutes, or case law - not the course text or any professor provided PDFs.

The structure of your paper should include:

  • Cover page
  • Overview: Describing the importance of your issue(s) to the current healthcare system
  • Issue: Clearly explain the issue that you are researching along with a brief explanation of all perspectives of said issue.
  • Rule/Review of the Literature: Summarized in words. Note that this should not be a "copy and paste" of literature content, nor should this section be substantially filled with direct quotes from the article. A literature review is a summary of the major points and findings of each of the selected articles (with appropriate citations). Direct quotations should be used sparingly. Normally, this will be the largest section of your paper (this is not a requirement; just a general observation).
  • Analysis/Practical Application: Using the literature (articles, case law, statutes, etc.) describe how your findings can provide an answer to this issue posed at the beginning of your paper to improve the current healthcare setting.
  • Conclusion: Provide a conclusion or answer to the issue posed at the beginning of your paper.
  • Reference page: APA formatted reference page.
