Pickens and Dillon work for Mickey's Meats, Inc. Pickens works the day shift, and Dillon works the night shift. In their jobs, they both use the same grinder to grind meat into hamburger. As a safety measure, there's a removable guard located five inches inside the mouth of the grinder. The guard prevents a person from putting a hand into the grinder's cutting blades. Because it's inside the grinder, the guard can't be seen easily, even by the person operating the machine.

The grinder makes the grinding process slower than it would be if the grinder didn't have the guard. One night, Dillon is behind on his production quota for the shift, so he turns off the grinder for a moment, reaches into the machine, and removes the guard. When the shift is over, he finds that he's unable to get the grinder back in place, so he hides it in his locker. The next day, while the grinder is running, one of Pickens's co-workers walks by and playfully shoves Pickens. Pickens falls and, in the process, accidentally puts his hand into the grinder. Later, it's discovered that Dillon removed the guard. Pickens sues Dillon to recover his damages. Pickens will probably win the suit.
