His normal duties as an employee of the law firm are to research the law as instructed by the attorneys in the law firm and prepare memorandums analyzing the law and facts of cases of the law firm. One Friday morning, an attomey at the firm, instructed Able to take and an answer to a complaint to the courthouse and file it immediately. The answer was over due and a default could be taken against the law firm's client if the plaintiff arrived at the courthouse first that day. Able rushed out the door with the answer and drove to the courthouse. On the way, Able, who was driving 20 miles per hour over the speed limit failed to stop at a red light and crashed into Baker. Baker was injured and Baker's car was damaged beyond repair. Baker sued Able and Dewey Cheatum and Howe to recover damages. Able will not be liable because the doctrine of respondeat superior applies to the circumstances. Dewey, Cheatum and Howe will have no liability because the run to the courthouse was not a normal activity of Able (so it was not in the scope of employment and the doctrine of respondeat superior does not apply. Able will be liable to Baker for the tort of negligence and Dewey Cheatum and Howe will be liable to Baker based on the doctrine of respondeat superior
