Xiong Hua has been importing mushroom seeds (i.e. spores) from seed shops in Wuhan, China, (a few blocks from Wuchang Railway Station) so that his mushrooms can be used as food or provide extracts for treating skin disorders. With the help of his scientist friend from X-Star, Xiong Hua has developed genetic engineering methods for modifying genes of the mushrooms seeds from those shops, enhancing metabolic process of the mushrooms, which provides distinctive shape, colour and flavour. Xiong Hua is unsure about the official criteria for obtaining legal protection for his new type of mushrooms. Furthermore, Xiong Hua worries if anyone will sue him for making use of the imported seeds for researching his new genetically modified mushroom. (i) Identify and state the IP rights relevant to Xiong Hua's new mushroom? (ii) Is there any government authority for protecting the IP right? Recall and state the legal criteria, if any, for obtaining the IP right protection. (iii) Can any seed company stop Xiong Hua's genetic research by suing seeds sold to him? After several months of testing, he has devised a new control logic that can connect riders' mobile phones to their Personal Transporters for achieving better maneuverability by utilising the computing power of mobile phones. Zac has asked you on how to benefit from his new control logic. Particularly, he has noticed that the US-imported Personal Transporter has printed phases of "Patented US 6, 862,723 B2" on its casing. Zac is not sure if he will infringe someone's patent if he investigates or/and installed his new control logic into the Personal Transporter. (i) Are there any IP rights relevant to Zac's new control logic? If so, what is the IP right(s) and why is it relevant? More than one type of IP rights may be relevant.
