Boats Inc. Owns a ship that it rented to Bob's Shipping Co. for 24 months. Bob's Shipping Co. wanted the ship so that it could conduct business by transporting goods to customers One term of the contract required that Boats Inc. provide a "seaworthy vessel" Another term stated that if the ship was out of service for repairs during the life of the charter, an equal length of time would be added to the end of the agreement. Unfortunately, the ship was unable to be used for four months at the beginning of the contract because the engines needed to be repaired. Bob's Shipping Co. also realized that it had paid too much for the ship rental. Bob's Shipping Co. claimed the delay caused by the broken engines was a breach of condition and elected to walk away from the contract. Boats Inc. denies this and says that the delay is simply a breach of warranty and, in turn, sues Bob's Shipping Co. for breach of contract. Do you think Boats Inc. will succeed in its lawsuit against Bob's Shipping Co. Please explain why.
