BOB went into FRED's grocery store where FRED was a clerk, and asked FRED if he would sell him his 2015 Toyota Camry car for $5,000.00. FRED thought about it for a minute and then stated "Sure, I will sell you my car at that price. BOB then gave FRED $2,500.00 as partial payment, and told him that he would pay him the rest in a week. FRED said "Fine". FRED then gave BOB the keys to the car and told him where it was parked. Just as BOB got to the parking spot where the car was, he saw another car crash into his "newly purchased car" causing severe damage. The driver of the other car left the scene of the accident, but, there were witnesses to the accident. After looking at the car, BOB decided that the car was to badly damaged to be driven. So BOB went back to FRED's store and told FRED of the accident and asked FRED for his money back. FRED refused to give BOB back his money. BOB now brings a lawsuit against FRED for the return of his money saying that "no contract existed as "nothing was in writing" and, also, "that BOB never received the paper title to the car and that FRED was still the owner." BOB also states that "the are was wrecked when I go to it. I never got to drive it". FRED counter-claims saying BOB still owes him the remaining $2,500.00 and wants BOB to pay him. First Question - BOB vs. FRED (For BOB to get back his $2,500.00 from FRED) List separately and then discuss each separate Defense. Set forth ALL of the Legal Defenses that BOB could use against FRED in order to show that there was not a legally enforceable Contract and, set forth any other Defenses that BOB could use to get his money back from FRED. Set forth and discuss the exact LAW(s) that BOB could use for each Defense. Second Question - FRED vs. BOB (For payment of the remaining $2,500.00) What would be FRED's Legal Responses (Defenses) to each of BOB's Defenses? Set forth the exact LAW(s) that FRED could use against each of BOB's Defenses in order to support his position and get his remaining $2,500.00 which he claims BOB still owes him
