Section C (Delict) Question 3 Larry Luckless and his wife Lucy were having a romantic meal at The No-Tell Motel. After drinking some 'Fizzy Popp' Lucy began to feel quite unwell and on inspection realised the bottle contained a decomposing mouse. Lucy suffered severe gastro enteritis which ruined the rest of their evening. Larry and Lucy complained to the restaurant manager who said, 'it's not my problem mate' but did offer them a replacement 'Fizzy Popp' and a mint with coffee. Larry was furious and stormed off leaving poor Lucy at the restaurant alone. The restaurant manager did eventually take pity on Lucy and gave her the name of the manufacturers of 'Fizzy Popp' but that just led to Lucy feeling even more confused. Thinking that the night couldn't get any worse Lucy was startled by a rabbit running across the road and she hit another car. The other car was driven by Louie Hamilton who wasn't wearing his seat belt and was singing along full volume to his radio. Lucy is now seeking your legal opinion. Advise her on her legal position and against whom she may have a delictual liability claim, and who may have a legal claim against Lucy
