Example Kevin is a sixteen-year-old high-school student. At six foot two he could easily be mistaken for someone several years older. Kevin decides to purchase a mobile phone plan and visits the Vodafone shop at his local shopping centre. Assuming Kevin is at least eighteen or older, the sales person does not ask for any form of identification and signs Kevin up to a twelve month mobile phone plan. Kevin subsequently runs up a very large bill which he is unable to pay and Vodafone seeks to recover. In these circumstances, Vodafone would have difficulty in recovering any money owed under its contract with Kevin who is a minor. A court would most likely consider that Vodafone had been remiss in not actually requesting any form of identification from Kevin before entering in to the twelve-month contract with him. Questions 1. What important detail did Vodafone fail to request? 2. Could Vodafone argue that this was in fact a contract for necessaries and therefore valid despite Kevin's age? 3. Do you believe the contract is voidable? Why / Why not
