Q1 (a) Malik, Ah Meng and Samy are partners in MAS Enterprise (the firm's) conducting construction business formed in 1$ January 2020. In the mutual agreement in writing between all partners, there was an agreed clause providing all the matters ordering the materials from the supplier must be handled by Malik and all matters pertaining to the operations and financial matters must be handled by all partners. All of these arrangements was made known and duly notified to all of the firm's supplier and client. On 1st January 2021, Ah Meng ordered cements from ABC Cements Sdn. Bhd. (cement supplier) but it was for the usage of his son's project in Melaka. On 2nd February 2021, there was an accident where the building structure belong to the MAS Enterprise project in Kota Tinggi fall and caused injury to Mr. A and his family. On 3"d March 2021, Samy's son, Muthu joined the MAS Enterprise as a new partner and replacing his father Samy who retired from the firm at the same time. Analyze the liability all partners of the firm with regards to the scenario below with reference to the provisions of law and decided cases. (i) Any claim from ABC Cements Sdn.
