The land in this question Torrens system land. Mandy, an Australian of South African origin, was the registered proprietor of a vacant block of land at No 2 Utopia Road, Swan Valley (the 'Swan Valley Property'). A month ago, Mandy, accidently left his Duplicate CT (as well as many other documents containing Mandy's sensitive & private details) in the back of Roger's taxi. Roger, the taxi driver, stole the Dup CT. One day, Roger asked Chad, a passenger in his taxi, whether he was interested in buying a vacant block of land in the Swan Valley. By coincidence, Chad was looking for property to buy. Roger told him that the land belonged to Mandy, a South African migrant, who was desperate to sell. Chad gave Roger his business card to give to Mandy. Two days later, Roger, pretending to be Mandy, called Chad and they organised to meet at the Swan Valley Property. Chad & his wife Lydia originally came from South Africa. Roger met Chad & Lydia wearing a fake beard, wig & glasses. Roger wore a T-Shirt with the South African flag. Roger introduced himself as "Mandy". As part of the small talk, Lydia asked 'Mandy' where he was born. Roger responded: 'uhm...Lagos'. Lydia: 'Lagos? That is in Nigeria' Roger appeared confused but said nothing. Lydia: 'You don't have a South African accent Mandy. Roger: 'Yes, I do. It is just that the South African accent is pretty much the same as the Australian accent - most people cannot tell the difference Lydia: 'Can we see you ID Mandy?" Roger: 'Can I tell you the price first: only $250k! What a bargain!" Chad [speaking over Lydia]: 'That is a great price. We will take it. Once we get registered as RPs, we will transfer you the money but not before' . Using the real Mandy's details, Roger helped Chad & Lydia became the Registered Proprietors of the Swan Valley Property. After receiving confirmation that they had become RPs, Chad transferred the $250k to Roger's nominated bank account. To his shock & horror, last week real Mandy discovered that he is no longer RP of the Swan Valley Property. Roger has also disappeared. Advise the real Mandy on his rights to the Swan Valley property in relation to the Chad & Lydia. |
