Our client, Naya Ahmed is a mechanical engineering student at the University of Illinois. Naya is a skilled Archer, having placed in the top rankings in the NCAA Women's Archery division.She was recently selected to represent the University and her country in the Olympics.

Naya was aware that traditional bows produce a lot of vibrations, which causes noise and handshock. She wanted to bulid a device to diminish the vibration and lead to improved accuracy, and keep the bow quiet for bow hunting.

After reading an article (please find here) she was inspired to design an attachment mechanism to the bow with an integral head and stem fabricated from a light elastomeric material with solid and split limbs.This item she thought would dampen the vibrations on the arrow when released from the bow, thereby maintain a more consistent. accurate and straight directional flow.She spent months perfecting her design and testing the devices in preparation for the Olympics.One week before the Archery event at the Olympics the newly created ArrowJet design by Naya Ahmed was revealed at a press event.

Jackie Wright, one of the founders of Bowjax and an avid Archer herself, was eagerly watching all the qualified Archers representing USA in the Olympics.When Jackie heard about Naya's ArrowJet device she was shocked and outraged.The device was an exact copy of her company's devices.She promptly retained patent counsel and dispatched a cease and desist letter to Ms. Ahmed.Jackie also filed for an injunction barring the use of ArrowJet in the Olympics and filed a patent infringement claim of their US6298842 patent in federal court.

Naya is clearly disappointed and confused.As an expert Archer she has never seen this device claimed by Bowjax and none of her competitors have used such dampening devices in the past.She does not understand issues of patent law or invalidity of patent claims. Naya wants to prevail against Bowjax and wants to invalidate the claims 1-4 of the '842 asserted in the BowJax patent .

(PART A = 30 points) Please conduct a comprehensive invalidity assessment against the target claims asserted against our client and recommend whether Naya should indeed pursue the strategy of patent invalidation or settle.Use the '842 patent's earliest priority date to conduct your analysis.

(PART B = 20 points) Based on your invalidity analysis from Part A, what elements must Naya have in her product to avoid infringement?Based on those elements (limit to 4 elements) please conduct a Freedom to Operate assessment and recommend whether Naya can sell her ArrowJet product in the United States without triggering infringement.
