Julius C. Aesar is the sole-owner of Julius Antiquities - a company specializing in the purchase and sale of rare Egyptian relics. On June 15, 2017, Julius hired Brutus to act as his lead sales agent Julius gives Brutus authority to create contracts for the purchase and/or sale of Egyptian relics priced up to $250,000. On June 16, 2017, Julius sends the following email to all of his known customers: "I would like to introduce my newest sales agent (Brutus) to you. I am sure that many of you have dealt with Brutus. Until last week, Brutus was the senior sales representative for Cleopatra Antiquities. Brutus is an expert in the field of Egyptian relics. I have full faith and trust in Brutus. I am confident that he will be able to meet your every need. Best regards, Julius" On March 14, 2021, Julius discovered that Brutus, along with others were engaged in a plot to steal over $1,000,000 of Julius' money. On March 15, 2021, Julius confronted Brutus and said "Yc too Brutus? Then you are fired!" Julius then published a notice that Brutus was no longer his agent in a newspaper of general circulation in the area where most of his customers were located. Julius also made a personal call to each of his customers to inform them that, as of March 15, Brutus was no longer employed by Julius Antiquities. Unfortunately, Brutus was unable to reach on of his wealthiest and oldest customers - Antony. Even so, Julius was confident that Antony would see the newspaper notice. He knew that Antony (or one of his agents) read this particular newspaper nearly every day looking for opportunities to purchase rare collectibles. Antony had dealt with Brutus as Julius' agent on 10 separate occasions, from 2017 through early 2021. All transactions were based on the extension of credit. Antony was not aware that Brutu: had been fired; he had not read the newspaper notice and had not received a phone call from Julius. On April 5, 2021, Brutus came to Antony, and claiming to be acting as Julius' agent sold Antony an Egyptian relic, accepting full payment of $100,000 in cash and promising to deliver the relic ir two weeks. Antony agreed to pay cash because the price for the relic was 20% below market. Brutus then disappeared, and now Antony is demanding that Julius honor the contract because Brutus was his agent. Julius disagrees explaining that he fired Brutus and gave notice and, therefore, Brutus was without authority to act. For purposes of your analysis, you should assume that all parties are residents of the state of Washington. DIRECTIONS As part of your analysis, you MUST use the following rule of law: To prove that Brutus was acting within the scope of his apparent authority, Antony must prove each of the following by a preponderance of the evidence: 1. Julius' words or conduct conveyed to Antony that Brutus had the authority to perform the particular act on Julius' behalf; 2. Julius' words or conduct actually led Antony to believe that Brutus had the authority to act; and, 3. Julius' words or conduct would have led a reasonably careful person under the circumstances to believe that Brutus had the authority to act
