Stanley owns and runs a limited company called Lifestyle Fitness Ltd ("LFL"). LFL operates a fitness centre in North Point. Members of the public may join by signing an annual contract with LFL, which is described in the contract as a 'membership' scheme. The cost of the membership scheme is HK$12,000 a year. In order to promote the fitness centre, Stanley offered to pay his younger brother, Marco, HK$7,000 if he helped him by delivering 3,000 leaflets in the North Point area and prepare YouTube video marketing the centre within 2 months. Marco agreed and delivered all the leaflets and the YouTube was well prepared as promised. The leaflets described the fitness centre as having an excellent range of facilities including well-equipped gym and training equipments. There was no written agreement between them. Tina, who is keen on fitness training, read one leaflet. Next day, she went to the fitness centre and entered into a contract with LFL. On Tina's first visit to the fitness centre she discovered that the gym contained barely any equipment. Stanley knew that the information printed in the leaflets are not true. a) Advise Marco whether he can successfully claim the promised HK$7,000 from Stanley if Stanley fails to pay Marco later.
