please help me!!!!!

Jim was driving at around midnight along Orchard Road when a pedestrian waved to him to stop. Jim stopped and the pedestrian, whose name was Steveni, asked for a lift to a nearby MRT station. Jim agreed to do so. However, Jim was very tired and he could hardly keep his eyes open. As he drove his car, he was so tired that he could not see where he was driving. Suddenly, he let go of the steering wheel and lost control and the car swerved onto a pavement and hit a tree. Due to the collision, Steven's neck was fractured and he was seriously in pain. Later, Steven brought legal proceedings against Jim under the tort of Negligence to claim for damages arising from the accident. Advise Jim on the legal action and the possibility of him being liable. Advise him on the following: a. Defining the elements of Negligence (2 marks); b. Whether there was a breach of the duty of care by Jim (6 marks) c. Whether the damage was caused by the breach and not too remote (6 marks) d. Can Jim resort to any defence. (6 marks)
