What are the liability hazards of requiring all members of the medical staff to take emergency department duty?

Medical staff, depending on their specialties and work hours are not always in the right mind or equipped to handle emergency care. Showalter (2020) discusses incorrect diagnoses occurring and delays in treatment by physicians who are on call in the emergency department. Emergency medicine is a branch of medicine that operates alone and staffs a whole group of physicians that practice emergency medicine specifically, so requiring on- call physicians that are not normally trained to assist in emergency medicine can lead to trouble. Although doctors are trained to treat, not all doctors are like emergency medicine physicians. Stress and fast judgment can result in misdiagnosis which can lead to malpractice and liability suits.

What effects have Good Samaritan statutes had on the duty to render aid in an emergency?

For those individuals who are physicians and medical professionals, Good Samaritan statutes have encouraged them to extend aid to those individuals who are in emergency situations and need care. Some of these statutes also ensure that medical professionals are not held liable for negligence if the situation ends poorly (Showalter, 2020). However, Good Samaritan statutes vary in different states, so it is important to know the laws and make decisions based on knowledge and ability to do so.
