There is no fault on X's part in causing the accident while Y's conduct conforms to all the delictual requirements including fault. X sufferers damage in the following. a) R45 000- fractured collar bone, b) R82 000- damage to his boat and c) R96 000- head injuries. The court finds that if X had worn the required crash helmet, his head injuries would have amounted to only R48 000. The court finds that there is 30% contributory negligence on the part of X in respect of the higher amount of his brain damage, while Y's negligence in that respect is 50%
