  • Prior to 1652 a variety of indigenous legal systems existed in southern Africa.
  • From 1652 the laws of the Netherlands' province of Holland applied at the Cape.
  • After the British invasion of 1795, Roman-Dutch law continued to apply (the Dutch returned between
  • 1803 and 1806).
  • However, the British invaded again in 1806 and this time it was permanent - at least until SA formally
  • became a republic in 1961.
  • During the 19thcentury two Boer republics, each with their own legislatures and laws, were also
  • constituted.
  • From 1948 a system of institutionalised racial segregation (apartheid) was adopted.
  • Independence from Britain and a new Constitution adopted 1961. However, no basic rights were
  • guaranteed.
  • The advent of constitutionalism from 1994
