Youstartedyourshiftat2100hoursonWednesdayOctober6,2022. You are a Police Constable ORANGE.
You were dispatched to Apt. 102 at 300 S. Parker Road at 2130 on Wednesday October 6thregardingloudshoutingandarguingcomingfrominsidethehouse(domesticdisturbance).A neighbour called the police to report a disturbance.
You arrive, park near the lobby, and look for the apartment. While looking for the apartment, you are met by Ferdinand MARTINEZ (neighbour) who advises you that the couple who live in Apt.102arealwaysyellingattheiryoungestchild andthathebelievestheparentsareabusiveto their youngest (approximately two years old). However, MARTINEZ has not seen them being physical with the child. Ferdinand advises that he does not believe they have any pets, but do have two older children, ages six and nine. You advise Ferdinand to go back into his apartment and that you would speak to him afterwards.
Once you find the apartment, you ring the bell. A man's voice shouts, "Shut up and leave us alone."Youringagainandannouncethatyouareapoliceofficer.Aman,PaulRUGBY,opens the door. You advise him of the call for the arguing and ask to come in and he complies.
Heletsyouin,andstatesheisthehusbandandliveswithhiswifeTinaRUGBYandtheirthree children, Aiden (aged nine), Gordon (aged six) and Cody (aged three).
Upon entering the apartment, you are standing in a hallway looking into the living room.You seeawomanwhoissittingonthesofa,staringatthefloor.Ayoungchild,approximatelythree- year-old, is laying on the floor and appears to have been crying. There is a red mark across the child's face.
PaulRUGBYisveryapologeticandsaysnothingiswrong.Youaskthewoman,TinaRUGBY, if everything is alright. She nods.
Twootherchildrenemergefromadoorlocatedtoyourright.Theyappeartobefrightened,but otherwise in good health.You ask the children to stay in the room so that you can talk to everyone in the family about what is going on.
Theadultmalerepeatsthatnothingiswrongandordersyoutoleave.Hesaysyouaretrespassing and he will call an attorney. You immediately call for a backup and do nothing further until another uniformed officer arrives.
Eight minutes later, Officers Mujeeb PARAMESWARAN (Badge #10023) and Lourdes D'ISRAEL(Badge#45632)arrive.OfficerD'ISRAELtakesTinaintotheMasterbedroomfor
questioning.OfficerPARAMESWARANstayswiththechildreninthelivingroomareawhile you ask Paul to accompany you to the kitchen area.

He tells you that his and Tina's youngest child, Cody, has been sick for three weeks and that Codyhasbeencryingnon-stop.Paulworksshiftworkandneedstosleepduringthedays.Tina is a stay-at-home mom who is responsible for taking care of the children.Due to Cody being sick, a lot of the housework that Tina is usually responsible for has not been completed.You notice that there are dirty dishes all over the kitchen counter, spoiled food on the table and bags of garbage piled into the corner."I may have lost my cool," he says.
OfficerD'ISRAELreturnsfromthebedroomwithTina.D'ISRAELsaysthatPaulgotangry with his child over the constant crying and slapped the child across the face to quiet him.
TinaalsomentionedthatPaulusuallygetsangryatthechildrenwhentheyareloud,buthehas never hit any of them until today.
You and Officer D'ISRAEL return tell Paul to stay where he is and return to the living room to talk to Officer PARAMESWARAN.Officer PARAMESWARAN mentions that the older childrenappeartobeshy,butotherwisehealthy.AidenandGordon(theolderchildren)mention that their dad often yells at them for being loud when their dad is trying to sleep. Officer PARAMESWARAN mentions that the youngest child, Cody, is covered in bruises in areas that he feels are not typical for a three-year-old.
