Law is simply words, and words are subject to interpretation. Interpretation of words is the primary role of the courts. The primary reason for stare decisis (the requirement to follow precedent) is to provide consistent interpretations. The United States Supreme Court is the ultimate "interpreter" of the Constitution, and interpretation of words is not simply an academic exercise; individual values, political considerations, and social context factor in heavily.

The most famous and consequential interpretations in American history are Plessy v. Ferguson, decided in 1894, and Brown v. Board of Education, which interpreted the "Equal Protection" Clause of the 14th Amendment in an entirely contrary fashion without one word of that Amendment being changed over the 60 year period.

Please answer the following questions after reading the Brown case. You may find a summary of the Brown decision in Chapter 4, pages 128-129. You will also find these cases and many interesting and pertinent discussions online.

1. Please use your own words to explain the rationale of theBrowncourt in reversing thePlessydecision, providing a short factual summary of both cases in your discussion. This discussion and explanation should be approximately one page in length.

2. There are, at least, two fundamental factors that led the court to entirely reverse its earlier interpretation despite no change in the words. What would be your "best guess" as to one of them? Please state and explain your answer.

3. Finally, in your opinion, what is one reason, legal or otherwise, that the Brown court did not strike down segregation "across the board" rather than limiting their decision to only public education? (Note: the Brown ruling was extended to cover all other aspects of public life over the next 10-15 years by the Court and by Congress).
